Spousal Sponsorship Application
Summary
Our client had been denied a spousal sponsorship application because the immigration officer didn’t believe the relationship was genuine. We submitted a reapplication for them and within 10 months they recieved approval and they could finally reside in Canada together.
Background
Indaresh Sakakar is a Canadian Citizen. He got married to Lalima Kaur, an Indian citizen. Indaresh called us to schedule an appointment with one of our legal representative to discuss the process of a spousal sponsorship application. During the consultation, Indaresh confessed to us that he submitted a previous spousal sponsorship but it was refused because the immigration officer did not believe that the relationship was genuine. Understandably Indaresh was frustrated because he felt like he wasted time and money. Our representative proceeded with helping Indaresh and Lalima reunited in Canada. We had to act fast and accordingly. The representative went on by asking about Indaresh relationship with Lalima and what steps they have to take from now. Since Lalima resided in India and she still had a few social obligations to attend too so the representative suggested re-applying for an overseas spousal sponsorship application.
Indaresh hired the firm within the following week of doing the consultation and we sent him the document checklist customized to Indaresh and Lalima’s circumstances than one of our representatives called him to go over the checklist step by step. Following a couple of weeks we began receiving the documentation indicated in the checklist. Indaresh was astonished of how much work and documentation goes into a spousal sponsorship application. The representative assigned to his file began to develop the application by reviewing the documentation received by Indaresh and Lalima. Lalima was residing in India so the representative kept track of our mail to see if Lalima documents from India have arrived.
With all the documentation obtained for the application we were able to develop strong argument of genuineness of relationship, how the sponsor can support the basic needs of the applicant and explaining their story line correctly. We further explained the nature of their relationship by addressing any possible issues such as large age gap, education, social, and cultural background differences. Nevertheless they fell in love with each other and through various routes of communication they were able to develop a strong connection that eventually led them to bind their love in matrimony.
A little under three months of hiring the firm we were able to submit the spousal sponsorship application to its respective place. We received communication from CIC about the application being received; they informed us of a UCI and application number. We kept up to the date with this application by submitted the bio-metrics and medical exam.
The application was within its final stages, but the couple had to undergo an interview before the immigration officer can make his final decision.A few months after going for the interview we received communication from Citizenship and Immigration Canada that Indaresh and Lalima’s application had been approved. They received the final decision within ten months of submitting the application.
Indaresh and Lalima were very happy they could finally reside in Canada together.
